Manufacturer of Wellbutrin Settles Cases for Another Prescription Drug

The Wall Street Journal (7/20, Stovall) reported that on July 20, GlaxoSmithKline announced in a company email that it settled certain suits claiming that its antidepressant Paxil (paroxetine) caused birth defects in the babies of certain users who took the medication while pregnant. “GlaxoSmithKline Plc has agreed to pay more than $1 billion to resolve more than 800 cases…according to people familiar with the settlements,” Bloomberg News (7/21, Feeley, Kelley) reports. “The accords, which provide an average payout of more than $1.2 million to families of affected children, leave more than 100 birth-defect cases pending, the people said.” According to Carl Tobias, who teaches courses on mass-tort law at the University of Richmond Law School, the “$1.25 million average recovery in the Paxil birth- defect cases reflects the seriousness of the injuries and the fact that many of cases involved children with heart defects.”

Wellbutrin (bupropion HCI), which is manufactured by GlaxoSmithKline, was first approved by FDA as an antidepressant in December 1985. The drug was shortly thereafter taken off the market after there were a large number of seizures associated with the medication. The latest study, after looking at 12,700 children born in the U.S. between 1997 and 2004, found that mothers who used Wellbutrin/bupropion during their first trimester were more than twice as likely to give birth to an infant with a congenital heart problem known as a left outflow tract defect.
